Privacy policy: how we use your data

1. Introduction

This privacy policy explains how Biedadviseur.nl processes personal data when you use our website, request a report (the free basic report or the paid bidding advice report) or take out a Home Alert. We treat your data with care and in accordance with the General Data Protection Regulation (GDPR).

2. Who are we?

Biedadviseur.nl is the data controller for the personal data processed via this website. Chamber of Commerce (KVK): 42008725. For privacy questions, contact info@biedadviseur.nl.

3. What data do we process?

We only process data needed to deliver and improve our service.

Contact and request data: email address, your relation to the property, and the chosen address (postcode, house number, house letter, suffix).
Property data for the analysis: asking price, living area, plot area, property type, energy label, year of construction, number of bedrooms/floors, WOZ data and the bidding deadline (insofar as you provide them, or we find them in public sources such as the home's listing on Funda).
Process and transaction data: flow ID, status steps in the request process, timestamps, chosen options (such as additional ownership information), the moment you clicked Pay after entering your email address, and whether and when we sent you the free basic report.
Technical usage data: user agent, screen and viewport dimensions, language setting and time zone, and your IP address. We use the latter only to limit misuse, by counting sign-in and report requests per internet connection; we keep it no longer than that requires, usually a day.
Where your visit came from, when you request a bidding advice or basic report or set up Home Alert: the page you arrived on, the website that referred you (without search terms or other additions) and any campaign codes in the link (utm). This shows us which channels lead to requests. The click ID that Google Ads or Microsoft Advertising adds to an ad link is kept only if you accepted marketing cookies. The identifier from the Google Analytics cookie is kept only if you accepted analytics cookies (see article 11).
Optional: if you choose ownership information, we process data from public/Land Registry (Kadaster) sources that may be included in the report.

If you take out a Home Alert, we additionally process:

Your name: first and last name, so we can address you and so the payment is in your name.
Your search: the areas you choose or draw on the map (stored as coordinates), and your minimum requirements as to property type, willingness to renovate, asking price, living area, plot area, year of construction, number of bedrooms and energy label, plus any further requirements you write yourself.
Changes to your search: what you changed and when, so we can show you why you did or did not receive a particular home.
Sending data: which homes we sent you on which day, and which reports you requested for them.
Subscription and payment data: the customer reference and mandate reference at our payment provider, the status of your subscription and the dates on which it was collected. We neither receive nor store full account or card details ourselves.

4. What do we use your data for?

We use your data to prepare and send your bidding advice, record the request steps, secure our service, prevent misuse and improve the quality of the tool. Our analysis is intended as data-driven advice and has no automatic legal or similarly significant effect.

When you click Pay after entering your email address, you request the free basic report. We then use your email address and the chosen address to send you that report once, if about thirty minutes later you have not bought the premium report for that home. To decide that, we look only at the time of your request and the status of your payment; we do not track what else you do on the website for it. The basic report is not marketing but the report you asked for, with a link to the premium report in it. After that we send you no reminders, newsletters or other marketing.

For a Home Alert we use your data to run the subscription: comparing your search against the available homes, e-mailing you the matching ones each day, producing the reports you request, processing and confirming your changes, and taking the monthly payment. The daily e-mail is part of the service you pay for and is not marketing; you stop it by cancelling.

5. On what legal basis do we process data?

We process personal data on the basis of: performance of the agreement (delivering your report, including the free basic report you request, and running your Home Alert), legitimate interest (security, fraud and misuse prevention, quality improvement and being able to substantiate our service in the event of a complaint or dispute), and legal obligations (such as tax retention requirements). Where legally required we ask for consent.

6. How long do we keep data?

We do not keep personal data longer than necessary. As a rule: request and flow logs for a maximum of 12 months, report and analysis data for a maximum of 24 months, and administrative records (where applicable) according to statutory periods (usually 7 years). For a Home Alert we keep your search and its changes for as long as the subscription runs and for 12 months afterwards, so you can come back without filling everything in again and so we can look into any complaint. The reports you requested stay available through your account; if you would rather they did not, we delete them on request. Subscription and payment data fall under the 7-year tax retention requirement. We keep no file of the free basic report ourselves; only the copy of the email in which we sent it reaches us at info@biedadviseur.nl. In specific cases we may keep data longer when needed for a legal dispute or statutory obligation.

7. Sharing with third parties

We do not sell your data. We only share data when necessary for our service, for example with:

Payment processing (Mollie) for handling online payments.
Email delivery (Brevo) to send you your report.
Address autocomplete (gratis-postcodedata.nl) to enable address selection.
Data sources for property information, such as Funda, Walter Living (WOZ history), public sources and Land Registry (Kadaster) data when you choose that option. Only data about the home goes to them, such as its address, and not your name or email address.
OpenAI, to look the home up in the current listings and to analyse the listing text. Here too only data about the home goes to them, and not your name or email address.
Technical suppliers for loading web resources (such as CDN/font services).
Google Ireland Limited for website statistics (Google Analytics 4) and advertising measurement (Google Ads), solely after you have given consent (see article 11).
Microsoft Ireland Operations Limited for advertising measurement (Microsoft Advertising), solely after you have given consent (see article 11).
Microsoft Ireland Operations Limited for insight into how visitors use the website (Microsoft Clarity). Clarity places cookies only with your consent (see article 11).

For a Home Alert we do not share your data with agents, sellers or other providers of homes. We do not register you with the listings we send you and we do not tell anyone that you are looking at a particular home: you approach the selling party yourself, when you choose to. Beyond the suppliers listed above, nothing about your Home Alert goes to third parties.

If personal data is processed outside the EEA, we put appropriate safeguards in place, such as standard contractual clauses where needed. For Google, data may also be processed in the United States; Google participates in the EU-US Data Privacy Framework and we have accepted Google's standard data processing terms and standard contractual clauses. OpenAI may also process data in the United States; this concerns data about the home only.

8. Security

We take appropriate technical and organisational measures to protect personal data, such as access restriction, logging, and secure data transfer where possible. No system is 100% secure, but we do everything we can to limit risks.

9. Your rights under the GDPR

You have the right to access, rectification, erasure, restriction of processing, objection and data portability. You can also withdraw previously given consent. Send your request to info@biedadviseur.nl; we normally respond within 1 month. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

10. The Home Alert in detail

The Home Alert runs on data you provide yourself, together with property listings we gather. Because a search says a fair amount about you (where you want to live, what you can spend), here is exactly what we do with it.

The areas you draw. If you draw an area on the map, we store its corner points as coordinates. We use them solely to decide whether a home falls inside your area. We infer nothing else from them and do not link them to your location data: we neither know nor record where you are.
The map itself. The map background comes from OpenStreetMap. Your browser fetches those map tiles from OpenStreetMap directly, which makes your IP address and the part of the map you are viewing known to them. What you draw does not go to OpenStreetMap; that stays with us.
Your own further requirements. The further-requirements field is free text. We read it to judge which homes to send you. Please do not enter special category data there, about health, religion, political views or origin, because that is not what the field is for and we do not ask for it.
The daily e-mail. We send it through Brevo, our e-mail provider. A copy of every send reaches us at info@biedadviseur.nl, so we can check what you received if you ask us about it.
The reports. Every report you request is stored as a file linked to your account. The link in the e-mail contains a unique, unguessable key for that one home; anyone holding that link can open that one report. So do not forward the e-mail to people who should not see the report.
No automated decision-making. The selection decides which homes you get to see, and nothing more. No decision is made about you that has legal effects or similarly significantly affects you.
Cancelling. If you cancel, sending stops at the end of the month you have paid for. We keep your search for a further 12 months as described in section 6; if you would rather we did not, tell us and we will delete it sooner.

11. Cookies and similar technologies

We distinguish three categories. Only the first is placed without consent; the other two are placed solely after you have given permission via the cookie notice.

Necessary. For the account feature we place a single strictly necessary (functional) cookie that keeps you signed in. We also store your cookie choice itself in your browser's local storage, and keep which page and link you arrived through in your browser's session storage; it is cleared when you close the tab. Both are required to deliver the service you requested and therefore do not need prior consent.
Analytics. With your consent we use Google Analytics 4 to measure how many visitors the site has, which pages are viewed and where visitors leave the request flow. For this, Google places cookies (including _ga) containing a randomly generated identifier. If you make a request (bidding advice, basic report or Home Alert), we store that identifier with your request. This lets us see which visit in Google Analytics led to which request, so we can improve the site and the request flow. We do not send your email address or other request details to Google. Without this consent we do not store the identifier. We also use Microsoft Clarity to see how visitors use the pages, such as where they click and how far they scroll. For this, Clarity records page visits; entered data and other sensitive content are masked in these recordings by default. With your consent, Clarity places cookies (including _clck and _clsk) to link several page views to one visit. We use these recordings to improve the site and do not link them to your request or email address.
Marketing. With your consent we use Google Ads and Microsoft Advertising to measure which advertisement leads to a request and to personalise advertising. Without this consent no advertising cookies are placed and no personalisation takes place.

We use Google Consent Mode v2 and the consent modes of Microsoft Advertising and Microsoft Clarity: for as long as you have not made a choice, or have refused consent, all consent signals remain set to denied and Google and Microsoft place no cookies. Clarity then treats every page view separately, without linking it to an earlier visit. You can change or withdraw your choice at any time via the Cookie preferences link at the bottom of every page. In addition, external services (such as font or script providers) may process technical data when the page loads.

12. Third-party data in reports

If you choose ownership information, the report may contain personal data of third parties from public/Land Registry (Kadaster) sources. This information is provided solely for the analysis you requested and may not be used unlawfully or distributed further.

13. Changes to this privacy policy

We may amend this privacy policy, for example when legislation or our service changes. The most recent version is always available on this page, including the date of the last change. In the event of any discrepancy between the Dutch privacy policy and this English translation, the Dutch version prevails.
